WHO WE ARE: We are Gust Vision Inc. d/b/a Powder (“Powder” or “we”, “our” or “us”).
OUR GENERAL TERMS: These terms and conditions (“General Terms”) govern your (“you” or “your”) access to and use of the Powder PC App, the Powder website, and/or our Services (collectively, our “Platforms”). These General Terms also govern our Privacy Policy and our Licenses, which are incorporated by reference. These General Terms, our Privacy Policy, our Licenses, the Community Guidelines constitute the complete agreement “Agreement” between you and us.
If you don’t agree to these General Terms or any other part of the Agreement, you are not permitted to access and use our Platforms and must stop using our Platforms immediately.
UPDATES TO OUR GENERAL TERMS: We may change or update these General Terms and other parts of the Agreement from time to time. Any changes will be effective immediately upon our posting of any updates or changes. Your continued use of the Platforms constitutes your agreement to the then-current Agreement. Please review these General Terms and all aspects of the Agreement regularly to ensure you are updated. If you do not agree with any changes or updates to these General Terms or the Agreement, you must stop using the Platforms immediately.
13+ AGE REQUIREMENT FOR ALL USERS All Users must be 13 years or older to use our Platforms. This includes our direct individual Users, and any end-Users authorized by any corporate User to access our Platforms and Services under the Licenses.
Individual Users of our PC Application: Users of our PC Application who are individual persons must be 13 years old, or older. You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you have received your parent’s or guardian’s permission to use the Platforms and have gotten your parent or guardian to agree to this Agreement on your behalf).
By signing up and using our Platforms, you represent that you are at least 13 years of age or older. If you are under 18, you represent that you have your parent or guardian’s permission to use the Platforms. Please have them read this Agreement with you.
If you do not confirm that you meet the minimum age requirement, the Platforms will automatically close, and you will not be able to use them. We may also cancel your account and revoke your access to the Platforms and Services if we reasonably believe or discover that you are under the age of 13 or lack the necessary parental or guardian consent if you are under 18.
Parents or Guardians of Users Under 18: If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Platforms, you are subject to the terms of this Agreement and are responsible for your child’s activity on the Platforms.
