Effective Date: June 18th, 2024
This license document (“License” or “Licenses”, as applicable) grants our Users specific licenses to our Platforms and Services provided by Gust Vision Inc. d/b/a Powder (“Powder”, “we”, “our” or “us”). The Licenses described below govern both our PC Application and our Web Application, as explained below.
This License forms part of the Agreement with us, and is incorporated into, and governed by, our General Terms . All capitalized terms below that are not defined in this License have the meaning given them in our General Terms .
By using our Platforms and our Services, you: (a) Represent that you meet the criteria for eligibility to use the Platforms and Services contained in this License; and (b) Agree to be bound by this License.
A. PC Application Subscription Levels
We currently offer three (3) levels of subscriptions to our PC Application.
(1) Enthusiast Level (Free): For gamers or aspiring content creators, not relying on content creation as their full-time occupation. By registering for the Enthusiast Level (Free) of our PC Application, you agree that: (i) You meet these requirements; (ii) You are not a professional content creator, organization or company; and (iii) You will provide accurate and truthful verification information where requested by us in the sign-up process and in subsequent communications with Powder. These types of information are also described more fully in our Privacy Policy .
(2) Professional Level (Paid): For professional content creators. $19.99 per license per month.
A professional content creator is defined as an individual who treats content creation as their full-time occupation, is self-employed, and/or owns their own company. By registering for the Professional level, you agree that you are a professional content creator and will provide accurate and truthful verification information where requested by us in the sign-up process and in subsequent communications with Powder. If you are interested in an Professional Level subscription, you may contact us at [email protected] to discuss customizing your subscription to fit your company’s needs.
(3) Organization Level (Paid): For employees and contractors in revenue-generating organizations. $49.99 per license per month. By registering for the Organization level, you agree that you are part of a revenue-generating organization and will provide accurate and truthful verification information where requested by us in the sign-up process and in subsequent communications with Powder. If your company is interested in an Organization Level subscription, you may contact us at [email protected] to discuss customizing your subscription to fit your company’s needs.
B. Grant of License to Our PC Application and Services By registering for our PC Application and Services, and paying Powder the applicable User Fees, Powder grants you a limited, world-wide, non-sublicensable, and revocable license to access and use the PC Application solely as set forth in the Agreement (a) for as long as you pay the applicable User Fees, and (b) as long as you abide by the terms of the Agreement.
